Terms of Service

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement. Users under 18 must have parental or guardian consent. We reserve the right to terminate accounts of users who misrepresent their age.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete registration information. Notify us immediately at support@hopkings.club if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.

3. User Content

You retain ownership of content you post (photos, videos, listings, build logs, etc.). By posting content, you grant HopKings a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content within the Service and for promotional purposes.

You are solely responsible for your content. You agree not to post content that:

• Is illegal, defamatory, harassing, or threatening
• Infringes any third-party intellectual property rights
• Contains malware, spam, or deceptive material
• Violates any applicable law or regulation

We reserve the right to remove any content at our sole discretion.

4. Marketplace

The marketplace enables peer-to-peer buying and selling of vehicles, parts, and related items. HopKings is not a party to any transaction between users.

• All listings must accurately describe the item being sold.
• Sellers are responsible for fulfilling transactions they agree to.
• Buyers are responsible for verifying item condition before purchase.
• We do not guarantee the accuracy of listings or the conduct of any user.
• Disputes between buyers and sellers must be resolved between the parties.

We prohibit listings for illegal items, stolen property, or items that violate platform guidelines. Violations may result in account suspension.

5. Events & Competitions

Event listings are created by registered Promoters. HopKings does not organize, sponsor, or assume liability for any third-party event.

Ticket purchases are subject to the refund policy set by the Promoter. HopKings facilitates payment processing only. Competition scores and judging decisions are final as determined by the event Promoter and assigned judges.

By attending or participating in an event, you assume all risks associated with vehicular activities and agree to comply with all event rules and applicable law.

6. Promoter Accounts

Promoters agree to:

• Provide accurate event information
• Honor ticket sales and refund policies they publish
• Comply with all applicable local, state, and federal laws for their events
• Not use the platform to defraud attendees

HopKings reserves the right to remove events or suspend Promoter accounts for violations. Revenue share payouts are subject to Stripe Connect terms and our Promoter Agreement.

7. Payments & Fees

Payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service. HopKings retains a platform fee on transactions as described in the applicable fee schedule.

All fees are in USD. Refunds are issued at our discretion or as required by law. Subscription fees are billed in advance on a monthly or annual basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.

8. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Harass, threaten, or harm other users
• Create fake accounts or impersonate others
• Manipulate competition scores or leaderboard data
• Scrape, crawl, or extract data from the Service without permission
• Attempt to gain unauthorized access to any part of the Service
• Interfere with the proper functioning of the Service
• Post unsolicited advertising or spam

9. Intellectual Property

All trademarks, logos, and service marks displayed on the Service are the property of HopKings or their respective owners. You may not use them without prior written permission. The HopKings name, logo, and app design are protected intellectual property.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOPKINGS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless HopKings and its officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your participation in any event, or your violation of these Terms.

13. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, the platform, or third parties. You may delete your account at any time through account settings or by emailing support@hopkings.club.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved by binding arbitration in Los Angeles, California, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 7 days before the effective date. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
